Abstract:
Maritime disputes demand speed, expertise, confidentiality, enforceability. Arbitration offers binding awards, specialist tribunals, predictability and New York Convention enforcement. Mediation offers party autonomy, confidentiality, cost/time efficiency, creative settlements and relationship preservation; the Singapore Convention and IOMed add cross-border enforceability and institutional support. Way forward: not choosing one over the other but a sequenced hybrid—mediation where preservation and efficiency matter; arbitration where finality and enforcement are essential.
About the Speakers
Mr. Jagmeet Makkar
Director, Skillsplus,An independent arbitrator and educator after four decades of practical experience in technical and commercial shipping which includes contracts of carriage, shipbuilding, ship sale and purchase and, ship leasing amongst others. He is based in Hong Kong and is on the panels of several arbitration bodies.
